Rules and Regulations

  1. CHECK-IN TIME IS AFTER 4 PM AND CHECK-OUT IS 10:00 AM Arizona time. Failure to depart on or before 10:00 am could lead to a charge of one extra day of rental and will be deducted out of the guests’ deposits. Variations in these times of up to 3 hours may be given with the permission of the owner only in writing and are subject to a 50 dollars fee.
  • This is a NON SMOKING RENTAL.
  • There are to be NO PETS on the Premises.
  • We do not rent the villa for parties or special events.
  • We will not rent to vacationing students or singles under 25 years of age unless accompanied by an adult guardian or parents.
  • DAMAGE CLAIMS: A Damage Claim in the amount of up to $500 can be made after your departure if the following conditions are not met:
  • No damage is done to the home or its contents beyond normal wear and tear.
  • No outdoor activity or noise to disturb the neighbors has taken place after 10 PM. 
  • No charges are incurred due to contraband, or collection of rents or services rendered during the stay.
  • All debris, rubbish, and discards are placed in refuse containers, and soiled dishes are in the dishwasher.
  • All garage remotes are left on the kitchen island and the house is left locked.
  • No linens, towels or other household items are lost or damaged.
  • The number of guests did not exceed the number of guests specified on the rental contract and communicated to the owner.  The maximum number of guests at the house including children is 8. This is in accordance with the state of Arizona’s rule of 2 people per bedroom.

TERMS AND CONDITIONS

PAYMENT – 50% of the rental fee is required on signing and, when made, shall guarantee the reservation.

No later than sixty (60) days prior to arrival, guest will pay the balance of the rental rate.  Failure to make payment within 60 (sixty) days of arrival will constitute a cancellation by the Guest.  Owner will make reasonable effort to contact Guest at the address, phone number and email addresses above before canceling reservation for non-payment.

Owner may claim excessive cleaning costs, repairing damages or replacing missing items, excluding normal wear after your departure. 

If you are concerned about the possibility of a last-minute cancellation, please purchase travel insurance for your protection.  A few sources are TravelProtect.com, InsureMyTrip.com, and TravelGuard.com.

All guests staying at the house must be disclosed on this rental contract whether they stay the entire duration of the reservation or a part of it. No additional guests are allowed at the house if they were not part of the number of guests specified on the first page of this contract.

CARE AND USE OF PROPERTY – Guest acknowledges that the premises and furnishings are in good order and repair, and agrees to maintain the premises in a clean and sanitary manner and surrender the premises in as good condition as received, normal wear and tear excepted.

HOME SECURITY

Security on this vacation rental is covered by an outside video surveillance camera system.

NO DAILY CLEANING SERVICE – While linens and towels are included with the vacation home, daily cleaning service is not included in the rental rate.

FALSIFIED RESERVATIONS – Any reservation obtained under false pretense will be subject to forfeiture of advance payment, deposit, and/or rental money, and the party will not be permitted to check in.

IDEMNIFICATION – Guest agrees to save Owner harmless from all liability, loss or damage arising from any action whatsoever by Guest or Guests.  Owner shall not be liable for damage to or loss of property of any kind owned by Guests which may be lost or stolen damaged or destroyed by fire, water, defective refrigeration, Act of God, or otherwise while on the leased premises.  Owner shall in no way be liable for any damage, accidents, illnesses, or injury to Tenant or to any other person(s), including Tenant’s agents, guests, or invitees occurring in or about the Premises. By accepting this reservation, it is agreed that all guests are expressly assuming the risk of any harm arising from their use of the premises or others who they invite to use the premises.

POOL AND SPA – No Children under the age of 14 shall be permitted to use pool and spa unless accompanied and under the supervision of an adult over the age of 25.  Please note that it is not recommended that any persons use the spa for a period longer than 30 minutes and at a degree higher than 104 Fahrenheit.

SUBLETTING – Guest SHALL NOT assign or pledge this agreement or sublet the premises in whole or in part without the prior written consent of Owner.  Subletting may result in immediate termination of occupancy without refund of rent money paid in advance or of the security deposit.

HOLDING OVER – Guest agrees that occupancy of the premises beyond the ending date and time shall be considered a trespass unless this Agreement is extended in writing.  Guest acknowledges their status as a Guest within the meaning of the innkeeper statute, subject to removal at the end of the term agreed upon herein.  Nothing herein contained shall be construed to create a tenancy within the meaning of RSA Chapter 540.

WRITTEN EXCEPTIONS – Any exception to the above mentioned policies must be approved in writing in advance.

ACCEPTANCE – This document constitutes the entire agreement.  By signing below you will be creating a binding contract to rent the indicated accommodations and are subject to the terms, rules, regulations, and conditions of this agreement.  This agreement will be considered binding upon signature of both parties and payment of 50% of the total rental.
